Under sections 27 (1) (b) and 33 (2) (e) of Act No. 111/1998 Sb., to regulate higher education institutions and to change and amend other laws (“the Higher Education Act”), as amended,
and under Article 35 of the Constitution of the First Faculty of Medicine of Charles University, as amended, the Academic Senate of the First Faculty of Medicine has adopted the following Disciplinary Code for Students of the First Faculty of Medicine of Charles University as its internal regulation:
Article 1
Introductory Provision
Infringements of disciplinary rules by students enrolled in the Second Faculty of Medicine of Charles University (“the Faculty”, “the University”), the imposition of sanctions for such infringements, the disciplinary proceedings, and the details on the Disciplinary Board of the Faculty are regulated by the Higher Education Act,[1] the Administrative Procedure Code, the Disciplinary Code for Students of Charles University and this Code.*
Article 2
Disciplinary Board of the Faculty
1. The Disciplinary Board (“the Board”) has six members. Half of the members are students.[2] Two members of the academic staff and two students are alternate members.[3]
2. The term of office of the members of the Boardand alternate members is two years and begins with their appointment.
3. Membership in the Board and the position of an alternate member terminates:
a) upon expiry of the term of office;
b) before expiry of the term of office:
i. upon termination of membership in the Academic Community of the Faculty,
ii. on the date of delivery of the Board membership resignation or resignation the position of analternate member.
4. Where a position of a member of the Board falls vacant under (3) (b), the alternate member called by the chairperson of the Board takes the vacancy for the time remaining until the end of the term of office.
Article 3
Rules of Procedure of the Board
1. If the Board receives a proposal for the commencement of disciplinary proceedings with one of its members or alternate members, such member or alternate member is excluded from consideration of and deciding this matter.
2. The Board decides by secret ballot if at least one of its members so requires.
3. The Dean’s office provides assistance to the Board.
Article 4
Transitional Provisions
1. Disciplinary proceedings started before the date of legal effect of this Code will be completed under this Code and the Disciplinary Code for Students of Charles University.
2. The term of office of the Disciplinary Board appointed before the date of legal effect of this Code is not affected.
Article 5
Final Provisions
1. The Disciplinary Code for Students of the Faculty approved by the Academic Senate of the University on 28 November 2008 is hereby repealed.
2. This Code was approved by the Academic Senate of the Faculty on 22 May 2017.
3. This Code comes into legal force on the date of its approval by the Academic Senate of the University.[4]
4. This Code becomes effective on the first day of the calendar month following the date of its legal force.
